An LT11 or Letter 1058 — “Final Notice of Intent to Levy and Notice of Your Right to a Hearing” — is one of the most serious notices the IRS sends. It means the IRS has exhausted its standard collection process and is now formally notifying you that it intends to seize your wages, bank accounts, or other assets. You have 30 days to respond before collection action can begin.
What You Must Do Within 30 Days
The most important thing to know: receiving this notice triggers a 30-day window in which you can request a Collection Due Process (CDP) hearing. This is a critical right — and once that window closes, you lose significant appeal options. Here’s what your options are:
- Request a CDP Hearing — By filing Form 12153, you formally request a hearing with the IRS Office of Appeals. Collection action is typically paused while the hearing is pending. This is often your best first move, and we strongly recommend it in most cases.
- Set Up a Payment Plan — If you can’t pay in full, we can negotiate an installment agreement or other payment arrangement that stops the levy process.
- Explore an Offer in Compromise — If your financial situation qualifies, settling the debt for less than the full amount may be an option.
- Request Currently Not Collectible Status — If paying would cause severe hardship, the IRS can temporarily halt collection while you get back on your feet.
- Prove the Levy Is Wrongful — If you believe the debt has already been paid or the amount is incorrect, the CDP hearing is also the venue to raise those issues.
